Neighbours fall out over boundary

A ROW has erupted between a set of neighbours in Bicester over a two-inch fence boundary.
Police were called at the weekend after the animosity that exists between them spilled over and fence panelling was destroyed.
But now, each side said the other was to blame.
On Saturday, Chris and Mandy Fisher, of Buckingham Road, claimed their fence panelling was being taken down without their permission and
called the police.
But their neighbour, Jean McCubbin, said a notice was sent to their house, just nine yards away, by recorded delivery but went unanswered.
The dispute dates back to before Mrs McCubbin moved into her semi-detached house.
The Fishers' previous neighbour agreed that the fence could encroach into their garden by two inches, but the situation was never officially resolved.
The neighbour left and sold the house to Mrs McCubbin in 2005 and so began the three-year row.
The Fishers said Mrs McCubbin was a nightmare neighbour who made their lives a misery.
But mother-of-three Mrs McCubbin said she was constantly being harassed and abused by people living nearby.
She said: "All we are trying to do is renovate an old house, but we get accused of not having planning permission, of working too early and too late and of generally being very bad neighbours.
"It is just not true. I just want to get on with my life without all this hassle."
But Mrs Fisher, 42, the mother of seven children, four of them living at home, said: "We knew nothing about the fence panels coming down.
"I called the police straight away and the work was stopped.
"Mrs McCubbin says the fence is two inches over her boundary.
"We had an agreement with the previous owner that we could put the fence there.
"We have been advised by police that this is a civil matter and should be dealt with through solicitors.
"But we have already spent £5,000 on solicitors and we simply don't have the money to put things right.
"Our life is a nightmare, thanks to Mrs McCubbin."
Despite living just yards away, the neighbours now refuse to communicate with one another.
Mrs McCubbin, who moved from Blackbird Leys in Oxford to Bicester in 2005, said: "The agreement may have been with a previous owner, but I am the one who now owns the property and I want the proper boundary line adhered to.
"I do not want trouble with neighbours, but things like this always have two sides to the story and I have been harassed as well.
"It is all very unfortunate."
A Thames Valley Police spokesman said: "We were called at 9.45am on Saturday saying a neighbour was taking fencing panels down.
"We attended and advised them it was a civil dispute over a boundary and they should seek legal advice."

Well that's fair enough! Mr & Mrs Fisher knew from the start that their fence was on someone elses land, and if they got a new neighbour then the fence might have to be taken down.
So FFS, just take the stupid fence down and put a new one up that's on your OWN property.
There are wars going on in the world, people starving, people dying of cancer and aids, and all the Fishers can do is kick up a fuss about a fence that they knew was illegally placed!

Waste of time seeing solicitors, or County Courts. Similar thing happened to me, a letter was posted through the door, dictating the removal of TV Aerial, turn fence panels the right way round, and removal of downpipe, from from their property. (shared drainage soakaway in their garden). They since found out where the boundary IS at front and back of property.
All over a few inches why don't they both get a life..understand why people get the idea they can just destroy property instead of talking to people.

I know more about this story than the reporter as I actually live near these neighbours and watched the fence being destroyed by Derek Risibey & Co. I even have photographs and I would like to put the record straight. Ian Townsend (reporter) has misquoted. The £5000 solicitors fees is actually for an ongoing problem where Jean McCubbins 'cowboy' builders have actually 'rammed' an RSJ into Mr & Mrs Fishers
bedroom and another into the chimney, causing considerable damage. This happened almost 2 years ago years. Ms Jean McCubbin says that they must have pulled them through themselves!!! (Clever). The £5000 has nothing to do with the fence. This is just another of Jean McCubbins evil schemes to push people to their limit before they react and then she can twist things and make her accusations. Chuck Norris & Mr T. I am interested to know why you wouldn't mess with her? She aint the 'meak & mild' person she makes out to the Police she is, is she!

So its not that much of a small issue really.
I certainly wouldnt give that much of MY Land to my neighbour, especially if they seemed as objectionable as the Fishers.
The article also states that Ms McCubbin had written to her neighbour to try and sort the problem out, but to no avail.

people need to read the paper again.the fishers stated that they know the fence is in the wrong place.With neighbours like you i feel sorry for the mccubins. Slanders come to mind for some of the comments made.

Its their perogative what they keep in their garden. They can fill it with rubbish if they like, its their garden!! It doesnt mean the neighbours can reappropriate the McCubbins garden as they see fit. Perhaps if they had the three sheds I talked about, any rubbish could be stored in there?!
The fence is in the wrong place, and the neighbours should move it. I'm glad they have lost 5k on solicitors fees. It might stop them trying to steal other peoples property in future!
I also feel sorry for the McCubbins, I dont know if their garden is full of rubbish, but I dont blame them for wanting their land back .......

I just can't believe the nerve of this horrible woman. I would be intersted to know though, how Jean McCubbin had an agreement with the previous owner as she passed away about a year before the house even went on the market! I remember speaking to the previous owner Mrs Hare, who told me that she was very happy about the 'lovely' fence that the Fishers had put up, as hers had blown down and she was unable to replace it. I cant understand why Jean McCubbin thinks that this fence is in her boundary! Mrs Hares 'original' fence posts are still standing in the garden as can be seen from New Street through their purposely destroyed hedge. In fact, you can see one of the posts behind Chris Fisher in the above photograph behind the Fishers 'green' post. What does Jean McCubbin think she is achieving? If she does not want 'trouble' with neighbours, then why does she keep causing it? I would hate to live near their mess which looks like a scene from Iraq or have to constantly look at the 'patchwork monstrosity' which they have built (with or withour Planning Permission). Cherwell District Coucil should be ashamed & Jean McCubbin, you need lessons on how to be a 'decent & respectfull neighbour' & then you might even get a friend!

Jean McCubbin, if you sent a letter to the Fishers by Recorded Delivery advising of the removal of the fence, why dont you look on the Royal Mail website to see who signed for it!!! Maybe it ended up in the same place as the Notice of Intension to the Fishers for your Dormer! Just to set the record straight to most of you idiots in favour of Mrs McC-selfish…(if you don’t know her the idiot thing doesn’t apply to you…”hee hee”). Mrs McC-selfish is a type of person who doesn’t ask anything from anyone…SHE JUST TAKES and that’s with a snatch.
I’m the son of Elaine (ex neighbour) who has seen what Mrs McC-selfish is capable of. Anyone who knows my mother (Elaine Pontefract) and the Fisher family can tell you that they have the decency and the personality which is 1 in 1,000,000.
In a comment made by some idiot (BJB if think), apparently it is a disgusting and cowardly act to throw offensive remarks at Mrs McC-selfish...(even though these offensive remarks are just lies) tell me, what category does not asking for permission from both neighbours and the council for the horrific extension and the knock down of the fence come under?...and your going on about being disgusting and cowardly. Says a lot about your personality traits my friend!
Now, I’m not a bright spark (like Daisy Duke, Mr T (aka Chuck Norris), L.England…****, and Farmer Palmer, all of which wouldn’t mess with her cos these t***s have probably seen her garden “ho hum”…) but I know about how to respect other peoples privacy and property. Even if a scientist can't count to infinaty, I bet s/he could measure the scale of all the above's dopeyness.
The only descent comments made on this page were by J and on the edge. The council should be doing something. That’s what we pay are taxes for.
Yes I agree totally that there are other negative things going on in the world but when it’s your own property/neighbourho
od that you dearly admire that’s being taken over from some home wrecker, it gets very frustrating…you want to get heard to fight this unfortunate battle so what better way…the press???
Mrs McC-selfish, weren’t you rejected from having planning permission on your previous place in BBL!!! Thought you’d wangle the council by not getting permission at Buckingham road ay? :-

Can you beleive some of the outragious comments on this page? Whoever BLB is I have no idea, but surely such comments would cause even more stress for all involved. I am friends with people that live the other side of Mrs McCubbin and trust me, this Mrs McCubbin has caused endless grief and upset to many many people. Now it seems her pals are adding to the mess. I am very very suprised that the News of the World has not taken up the action of the town council in all this!

I say: if you are a witness to the verbal abuse then its about time you stood up and told the truth about what you are hearing, for what reasons, what is actually going on, why and who is responsible. McCubbins Surveyor/Solicitor has a lot to answer for(professional!! Tesco bookwriter). Go on, be a man!!! Why is everyone so scared of Ms McCubbin! Oh, of course, it goes back to the dare I mention it 'racist issue'. She has even accused CDC of 'harrassment' for not having Planning Permission; they let her do as she pleases for fear of her next accusation! By the way Ms McCubbin does have a property in Blackbird Leys whether she likes to admit it or not (even in court), 1 Woodruff Close in fact where she has built a 2 storey extension which has to be knocked down due to not having planning permission. I hope it makes headlines in the papers when it eventually gets knocked down.
